Special Update for JVC Members in New York State  

 

New York State's   

WAGE THEFT PREVENTION ACT  
Now in Effect    

 

 New York's recently enacted Wage Theft Prevention Act requires employers in the state to give their employees written notice of their wage rates. The notice must be given to each all employees and any new hires by February 1st each year.

 

Among other things, the notice must include:

  • Rate or rates of pay, including overtime rate of pay (if it applies)
  • How the employee is paid: by the hour, shift, day, week, commission, etc.
  • Regular payday
  • Official name of the employer and any other names used for business (DBA)

The notice must be given in English and in some cases another language, if it is the employee's primary language. While the employer may use its own notice, it may also use the sample notice prepared by the New York State Department of Labor (DOL). These sample forms, available in a variety of language can be found on the Department's website at:
