The Export and Re-Import
of Burmese Rubies and Jadeite Already In the US


If a dealer is planning to export rubies and jadeite which were extracted or mined in Burma and present in the US prior to September 27, 2008, a dealer should use Customs and Border Protection Form 4455-Certificate of Registration or a CBP Form 4457-Certificate of Registration for Personal Effects Taken Abroad when leaving the US with the articles.  The use of the form registers the items with US Customs and puts Customs on notice that the articles can be legally re-imported.

When the dealer returns to the US, the dealer should have the Certificate of Registration for the articles exported from the US, along with any sales receipts for items sold.  The export and re-import must be by the same person or entity, and the articles cannot have been “advanced in value.”  This means that the rubies or jadeite exported and re-imported cannot have been cut, polished or set into jewelry.
