Update - Blue TopazJuly 19, 2007 - The Nuclear Regulatory Commission (NRC) requires that in order to import nuclear irradiated gemstones, the initial importer must be licensed to possess and distribute these products. Similar rules will soon be in place governing accelerator-irradiated gemstones. It appears from the research done by the JVC, there is no current NRC licensed entity for the import, possession or distribution of irradiated gemstones in the United States. Thus, many irradiated gemstones in the U.S. today are more than likely present without the benefit of full compliance with U.S. law. There are no allegations of which JVC is aware pertaining to any health or safety issues related to these gemstones. JVC has formed a task force consisting of suppliers, manufacturers and retailers, and representatives of other trade associations. JVC will lead a delegation to the government regulatory body governing these gemstones (the Nuclear Regulatory Commission) to address bringing the industry into full compliance. Retailers now offering irradiated gemstones for sale should consider the appropriate action to take, including but not limited to, removing these products for sale from their counters. There is no health and safety issue that is known to the JVC. This alert relates primarily to blue topaz, and could apply to other irradiated gemstones that you offer for sale. Please remember, if you choose to substitute coated blue topaz for irradiated blue topaz, it is required that you disclose to the consumer that the gemstone is coated, since this treatment may not be permanent, and requires special care. If you have any questions regarding this compliance update, please do not hesitate to contact the JVC at 212-997-2002. This update is not any form of legal advice.
